Legacy employer’s liability policies – we regularly see asbestos, repetitive strain, and deafness claims going back to the 1970s. Without documentary evidence, these claims are uninsured and can be considerable. And, in certain instances, TUPE regulations transfer the duty of care to the current employer. We can identify what risks you might face and arrange an Association of British Insurers (ABI) search to establish potential liabilities.
Environmental impairment – historically, any clean-up costs were passed onto the original ‘polluter’. However, recent changes in legislation now means an acquirer can be lumbered with the costs of clean up for an old operation.
